The law relating to equitable interests in land is developing in part due to a booming property market, leading to family members investing in property together. This development has resulted in greater litigation surrounding alleged oral agreements between family members (whether between parents and children or between siblings) entered into at the time of purchasing property.
In this CPD Adam Casselden SC and Carmel Lee will review key authorities in this area before examining recent cases from the NSW Supreme Court and Court of Appeal expanding the law in this field. Adam and Carmel will also provide helpful techniques for litigation to practitioners representing clients in these disputes.
