Ben Jacobs is a Sydney-based barrister specialising in building and construction law, and commercial law.

Ben regularly appears in the Federal Court, Supreme Court and District Court, as well as the NSW Civil and Administrative Tribunal (including the Appeal Panel).

Ben has always had a keen interest in the vigorous debate of ideas, and has translated that interest into a successful career at the bar. However, his career trajectory has not been a direct one by any means.

Ben began his working life as a chef in some of Sydney’s best kitchens, before putting down his chef’s knife to study Arts/Law. He next gained graduate entry into commercial law firm King & Wood Mallesons, before working as an Associate to Justice Branson of the Federal Court of Australia.

Ben’s depth and range of real-world experience contributes enormously to his ability to work with solicitors and clients alike, and to understand the multiple factors that lead them to the point of approaching counsel for assistance.

Ben is unfailingly professional and experienced in the processes of litigation and dispute resolution. He consistently builds strong relationships with solicitors and has open and informed discussions about each particular case. He is also committed to viewing issues and disputes from the client’s perspective, identifying their desired result, and communicating a realistic understanding of the potential outcomes.

In short, Ben knows the vital importance of remaining sensitive to the client’s needs while imparting practical legal advice. His ability and common sense allow him to achieve the best possible outcomes for his solicitors and their clients.

Ben's Notable Cases

Blacktown City Council v Allen Jack + Cottier Architects Pty Ltd & Statewide Civil Pty Ltd – NSWSC 2021/00039903. Ben is sole counsel advising the principal on this multi-million-dollar dispute in the NSW Supreme Court.

Acciona Infrastructure Australia Pty Ltd claims against Transport for NSW 2019, 2018 & 2017 – Sydney Light Rail. Ben was a junior counsel advising the contractor on this major infrastructure project on numerous disputes with the principal.

Blake v Calcorp Pty Ltd – NSWDC 2019/00173335. Ben appeared as sole counsel in these NSW District Court proceedings. He was involved in advising on the defence of the defects claims as well as the builder’s contractual and quantum meruit claims.

Goodwin Street Developments Pty Ltd v DSD Builders Pty Ltd [2018] NSWSC 1229. Ben was the sole counsel successfully resisting an application to quash an adjudicator’s determination under the Building and Construction Industry Security of Payment Act.
