In this seminar, Lucy Saunders will take you through some tips and the common pit-falls when drafting non-competition and non-solicitation restraints. In particular, Lucy will discuss when it is appropriate to include a non-competition clause, how to draft an enforceable non-solicitation clause and in what circumstances a non-dealing clause should be included.
Dilan Mahendra will then step you through a practical guide when it comes to enforcing restraints including how to successfully obtain injunctive relief or how to defend such proceedings, and how different strategies can and should be employed depending on the circumstances of each case.
