Developments in Work Health and Safety Law [2025]

Colin Magee and Malcolm Scott will explore a number of the significant developments in work health and safety law that arose throughout 2024.  Join us as we discuss important appeal decisions from the NSW Court of Criminal Appeal, including in relation to the construction of the limitation provision for the commencement of prosecutions under the WHS Act, and the issue of what constitutes “adequate” training and “adequate” safety procedures when there are identified risks of serious injury or death in a workplace. We will also discuss the focus of the regulators on the importance of considering psychosocial hazards in the workplace, and the growth of prosecution proceedings arising from the exposure of workers to psychosocial harm.
