Reconsidering Final Orders – Parenting and Property [2025]

Notwithstanding the legislature’s express intention was to ‘codify’ Rice & Asplund – which required a significant change in circumstances – the new section 65DAAA has created a groundswell of new applications to reconsider parenting orders. The first part of the CPD looks at the new section and recent authorities. The second part of the CPD will focus on reconsidering final property orders – specifically, s 79A applications as a result of impracticability, default or exceptional circumstances that have arisen in relation to the care of a child.
