We have woken up to a world where uncontroverted expert evidence  – that’s right, no cross-examination – can be criticised in submissions and then rejected (Griffiths v TU UK Limited), where an expert’s years of industry experience are not enough to overcome the lack of an academic qualification (Fonterra v Bega), and where an expert who strayed from the path of independence …..well, no surprises here (Dwyer v Volkswagen).  Expert evidence: it’s never dull.
