Superior courts have long retained the power to intervene to ensure the honourable conduct of legal practitioners, including with respect to charging fees. Though the jurisdiction is rarely invoked given the introduction and adoption of uniform laws and solicitor conduct rules, it has not been displaced. Sam Sykes will take you through the decision in Beau Timothy John Hartnett trading as Hartnett Lawyers v Anthony Robert Bell as Executor of the Estate of the late Mabel Dawn Deakin-Bell  NSWCA 244 where the Court stepped in to disgorge more than $230,000 of excessively charged fees within the Court's inherent supervisory jurisdiction. Sam will also touch upon the time by which a fixed sum costs order can be brought following judgment, a matter that was previously unresolved.
